Only registered members and guest accounts will be able to purchase from this Website. All the Products sold by WCK through this Website are sold subject to these Terms and Conditions. By submitting your order for processing by this Website, you confirm and affirm that you have read, understood and agree to these Terms and Conditions in the form in which they appear at the time your order is submitted for processing.

These terms and conditions shall prevail over any other document purporting to have a contractual effect including any WCK store policy.

The Customer shall agree to complete the registration process according to WCK’s requirements as stated on this Website. The Customer shall provide WCK with complete and updated information which shall include (but shall not be limited to) the Customer’s legal name, address, telephone and fax numbers (optional) and e-mail address.

Registration is open only to residents in aged 18 and above. WCK has the absolute discretion to refuse the registration of a potential customer for any reason whatsoever and to terminate the registration of any of its Customers for any reason whatsoever.

The Customer will be liable for every order made under his Login and agrees to indemnify WCK for all claims, damages whatsoever made by any third party arising from the actions of a person placing orders for the Products using the Customer’s Login. The Customer shall be responsible for updating his registration information.

WCK shall use its best endeavors to prevent any unauthorized entry to this Website. However, WCK shall not be liable for any damages or losses whatsoever if any third party gains unauthorized access to the this Website.

Any and all comments, posts or content posted or submitted or published on this Website (including its social media channels and/or platforms) by Customer or any visitor or user (“User Generated Contents” are subject to the following terms:
a) WCK shall be entitled to use, make or reproduce, disclose, distribute, create derivative works of such User Generated Contents, for any purposes whatsoever, without restriction and without any compensation to you. WCK is not and shall not be subjected to any obligations or confidentiality regarding the content, except where required by law. WCK is under no obligation to use or post any User Generated Contents.
b) All User Generated Contents, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such content originates. You will be solely and entirely responsible for any and all User Generated Contents that you upload, post, share or otherwise display. Under no circumstances will WCK be liable in any way for User Generated Contents including, but not limited to, liability for any errors or omissions in any User Generated Contents or for any loss or damage of any kind whatsoever and howsoever incurred as a result of the use of and/or reliance on any User Generated Contents.
c) WCK reserves the right to remove any User Generated Contents that is not relevant and/or which WCK in its own discretion deems inappropriate.
Price
WCK shall make every effort to ensure that the prices, details and sizes of Products detailed by this Website are correct but WCK reserves the right to vary the price and other details of the Products without notice.

The prices advertised by this Website are for home delivery shopping only. Prices for some Products may differ from those charged at WCK shops. The price of certain Products, in particular fresh produce, is subject to daily fluctuation and is offered for guidance only.

Not all Products sizes will correspond exactly to the description offered on-line. WCK reserves the right to provide the nearest size of Product at the nearest price.

Discrepancies between the on-line bill/order price and the final bill may be due to out-of-stock products, substitutions, special offers, daily price changes and weighed items. WCK reserves the right to adjust the final bill after the on-line bill/order price is presented or conveyed to the Customer and such adjustments shall be marked on the final bill presented to the Customer at the time of delivery.

In the event of different special offers or promotions being made available to the Customer simultaneously for the same Product, the Customer may elect one such offer or promotion per Product but shall not be entitled to a combination of all such offers or promotions per Product.

If the Customer requests a variation to the order which WCK accepts then the price payable for the order will be adjusted accordingly to reflect the variation and shall be recorded on the final bill presented to the Customer at the time of delivery.

WCK may from time to time set credit limits for individual Customers and WCK reserves the right to limit sales including the right to prohibit sales to re-sellers.

Value On What Counts – Terms & Conditions

During its “Value On What Counts” promotion, WCK will double the price difference of the items featured in its “Value On What Counts” ads, if identical items from any local competitor’s newspaper ad published within the promotional period are at a better price.

Valid only when item is from the same Country of origin and price is offered in the same unit type or bundle deal (eg. 100g for 100g; “Any 2” for “Any 2”, same gift type) for the same product variant.

Only the price difference will be doubled and refunded.

Customers who want to make a claim will need to produce the proof of purchase ( in the form of tax receipt or invoice) of the said item from the local competitor within 3 days from the date of purchase.

Only purchases made within the advertised period will be eligible for claim.

Payment

Payment for Products ordered through this Website can be made by the VISA card, Mastercard, American Express Card, JCB and PayPal.

WCK may change at any time the method by which payments for this Website’s orders may be effected and such changes may be notified to the Customer by e-mail or by placing a notice to this effect on this Website.

Delivery

WCK shall use reasonable endeavors to deliver Products of acceptable quality to the delivery address (specified by the Customer on the registration form) within the time windows selected by the Customer but WCK shall not be liable for any delays in its delivery services, if the delay has been due to causes beyond the control of WCK.

Property Risk

All risk in the Products shall pass to the Customer upon delivery to the Customer’s delivery address but WCK shall retain title in the Products until such time as payment for the Products has been effected.

Returns of Products / Refunds
Pictures of products provided on this Website are (i) provided for illustration purposes and to help with their identification; and (ii) subject to redesign and/or improvement and/or changes without notice. While we take all reasonable care to ensure that all descriptions, details and prices of Products appearing on the Website are correct at the time when the information was inputted into the system, the information may be different by the time an order is placed.

WCK shall use its best efforts to ensure that orders are correctly fulfilled. Should there be any discrepancy, please notify us either by e-mail at damascusknifesupplier@outlook.com. All refunds will be made via the same mode of payment on which the original purchase was made within 5 working days.9.4 All replacements of Products shall be effected in the shortest time possible.

Warranties

To the extent permitted by law, all warranties, descriptions, representations or advice given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise of the Products supplied, are expressly excluded.

No agent or representative of WCK is authorized to make any warranties, representations or statements regarding the Products and WCK shall not in any way be bound by any such unauthorized warranties, representations or statements.

Liabilities

The liability of WCK whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Products or any other breach of WCK’s obligations hereunder shall not in any event exceed an amount equivalent to the price of the Products.

The Customer shall ensure that the Products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that WCK assumes no obligation or liability for any advice or information given with the Products and WCK shall not be responsible for any inaccuracy or misstatement of any such information. The Products shall be accepted by the Customer entirely at the Customer’s risk.

Intellectual Property

All right, title and interest in all Intellectual Property in all concepts, systems, written, graphic and other material relating to this Website shall at all times remain the property of WCK.

WCK and other parties own the trade marks, logos and service marks displayed on this site/catalogue and/or in connection with the Products and Customers and on-line visitors are prohibited from using the same without the written permission of WCK or such other parties.

Variation of Terms & Conditions
WCK reserves the right to amend these Terms and Conditions in its sole discretion. WCK may, but does not undertake, to notify the Customer of such changes. It is the Customer’s responsibility to review the Terms and Conditions prior to submitting any order and WCK shall have no responsibility to notify the Customer of any changes to the Terms and Conditions prior to the coming into effect of such changes or otherwise.

Applicable Law

These Terms and Conditions shall be governed by the laws of and the Customer and WCK agree to submit to the jurisdiction of the courts.
